Resolution #24-006

RESOLUTION #24-006: A RESOLUTION DECLARING THAT HALL COUNTY IS NOT A SANCTUARY COUNTY FOR NONCITIZENS

PASSED AND ADOPTED MARCH 12, 2024.

Whereas, pursuant to Neb. Rev. Stat. §23-104(6), the County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and,
Whereas, pursuant to Neb. Rev. Stat. §23-103, the powers of the County as a body are exercised by the County Board; and,
Whereas, various news sources have recently incorrectly and misleadingly reported that Hall County is a "sanctuary county" for noncitizens; and,
Whereas, Hall County is not a "sanctuary county" for noncitizens; and,
Whereas, Hall County has no jurisdiction over federal offenses; and,
Whereas, Hall County is not legally authorized to detain someone based on their immigration status alone unless directed by a judicial authority; and,
Whereas, Hall County will continue to notify U.S. Immigration and Customs Enforcement of a noncitizen who has been detained on a local or state charge within Hall County; and,
Whereas, Hall County will continue to apply the law to citizens and noncitizens who are arrested within the County; and,
Whereas, Hall County has, and will continue, to cooperate with the U.S. Immigration and Customs Enforcement.
NOW, THEREFORE, BE IT RESOLVED by the Hall County Board of Commissioners that Hall County will cooperate with U.S. Immigration and Customs Enforcement and will apply the law as stated in the Constitution.
BE IT FURTHER RESOLVED that any report in conflict with this Resolution is not accurate and does not reflect the policy or procedures of Hall County.
The above Resolution was approved by a vote of the Hall County Board of Commissioners at a public meeting duly held in accordance with the applicable law.
