Resolution #24-006

RESOLUTION #24-006: A RESOLUTION DECLARING THAT HALL COUNTY IS NOT A SANCTUARY COUNTY FOR NONCITIZENS


PASSED AND ADOPTED MARCH 12, 2024.

  • Whereas, pursuant to Neb. Rev. Stat. §23-104(6), the County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and,
  • Whereas, pursuant to Neb. Rev. Stat. §23-103, the powers of the County as a body are exercised by the County Board; and,
  • Whereas, various news sources have recently incorrectly and misleadingly reported that Hall County is a "sanctuary county" for noncitizens; and,
  • Whereas, Hall County is not a "sanctuary county" for noncitizens; and,
  • Whereas, Hall County has no jurisdiction over federal offenses; and,
  • Whereas, Hall County is not legally authorized to detain someone based on their immigration status alone unless directed by a judicial authority; and,
  • Whereas, Hall County will continue to notify U.S. Immigration and Customs Enforcement of a noncitizen who has been detained on a local or state charge within Hall County; and,
  • Whereas, Hall County will continue to apply the law to citizens and noncitizens who are arrested within the County; and,
  • Whereas, Hall County has, and will continue, to cooperate with the U.S. Immigration and Customs Enforcement.
  • NOW, THEREFORE, BE IT RESOLVED by the Hall County Board of Commissioners that Hall County will cooperate with U.S. Immigration and Customs Enforcement and will apply the law as stated in the Constitution.
  • BE IT FURTHER RESOLVED that any report in conflict with this Resolution is not accurate and does not reflect the policy or procedures of Hall County.
  • The above Resolution was approved by a vote of the Hall County Board of Commissioners at a public meeting duly held in accordance with the applicable law.
